Terms of Service

These Terms govern your use of Oberdex, operated by TODO: legal entity name (e.g. "Borza Labs LLC") ("we", "us"). By creating an account or using Oberdex you agree to them and to our Privacy Policy. If you do not agree, do not use the service.

1. The service

Oberdex is a tool for tracking Pokémon trading card collections: holdings, wishlists, binders, price alerts, reports and card scanning. We may change, add or remove features at any time. Some features are only available on paid plans.

2. Eligibility and accounts

• You must be at least 13 (16 in the EU/UK). If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you.
• Oberdex may be invite-only. Invite codes are for the person they were given to.
• Give accurate information, keep your sign-in secure, and tell us if you think your account was accessed without permission. You are responsible for activity under your account.

3. Not financial, tax, or investment advice

Prices, values, gain and loss figures, graded-card estimates, grading return-on-investment estimates, and tax or sales reports are provided for information only. They come from third-party sources and our calculations, and may be wrong, delayed, incomplete or unavailable. They are not financial, investment, tax or legal advice. Cards can lose value. Do your own research and consult a qualified professional before buying, selling, grading or filing taxes. We make no guarantee of the accuracy of any figure or of any future value.

Card recognition from photos is automated and can be mistaken. Check each match before saving it.

4. Paid plans

• Billing. Paid plans are billed through Stripe at the price shown at checkout, in advance, on a recurring basis until cancelled.
• Cancel anytime from the billing portal in Settings. Cancellation takes effect at the end of the current billing period; you keep access until then.
• Refunds. Except where the law requires otherwise, payments are non-refundable and we do not refund partial periods. If you think you were charged in error, contact us within 30 days.
• Price changes. We may change prices. We will give you notice before a change applies to your plan.
• Taxes. Prices may not include applicable sales tax or VAT, which is added where required.
• Limits. Plans include limits (for example the number of cards and active alerts). If your plan ends or you exceed limits, we may restrict adding more, but we will not delete your existing data because of it.

5. Your content

You keep ownership of the data you enter (your collection, notes, binders and so on). You give us a limited, worldwide licence to host, process and display it only as needed to run the service for you, including showing it to others as you choose through sharing settings. You are responsible for what you share. Do not enter anything you do not have the right to share.

6. Acceptable use

You agree not to:

• break the law or infringe anyone's rights;
• scrape, copy or resell the service or its data, or use it to build a competing product or dataset;
• probe, attack, overload or circumvent the security or limits of the service, or access another user's data;
• use bots or automation beyond the app's own features, or share your account or invite code;
• upload malicious files, or harass or impersonate others (including through friend requests or shared binders).

We may suspend or remove accounts that break these rules.

7. Our property and third-party content

Oberdex, its design, code and original content belong to us. You may use it only as these Terms allow. Pokémon and its characters, card names, artwork and set logos belong to Nintendo, Creatures Inc., Game Freak and The Pokémon Company. ONE PIECE and its characters, card names and artwork belong to Eiichiro Oda/Shueisha, Toei Animation and Bandai. Oberdex is an independent fan-made tool and is not affiliated with, endorsed by, or connected to any of them. Card images and logos are shown for identification and informational purposes. Prices and catalog data come from third-party providers and remain subject to their terms; you may not redistribute them.

Links to TCGplayer, eBay and other sites are provided for convenience. We do not control those sites and are not responsible for them or for any transaction you make there.

8. Copyright complaints

If you believe content on Oberdex infringes your copyright, email [email protected] with the material you believe is infringing, where it appears, your contact details, a statement that you have a good-faith belief the use is not authorized, and a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner. We may remove content and terminate repeat infringers.

9. Ending your account

You may stop using Oberdex and delete your account at any time from Settings. We may suspend or terminate your access if you break these Terms, if required by law, or if we discontinue the service (we will try to give reasonable notice and a way to export your data). Sections that by their nature should survive termination will survive.

10. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise the service will be uninterrupted, error-free or secure, or that data will never be lost. Keep your own backups of anything important; you can export your collection at any time.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or losses from buying, selling or holding cards based on information in Oberdex. Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) US$50. Some places do not allow these limits, so they may not apply to you in full.

12. Indemnity

You agree to defend and reimburse us for claims, damages and costs arising from your content, your misuse of the service, or your breach of these Terms, to the extent the law allows.

13. Governing law and disputes

These Terms are governed by the laws of the State of TODO: state, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve it informally for at least 30 days. Courts located in TODO: state have exclusive jurisdiction, and you consent to them, except that either party may seek injunctive relief anywhere. Consumer rights that cannot be waived under the law where you live are not affected.

14. Changes to these Terms

We may update these Terms. For material changes we will notify you in the app or by email before they take effect. Continuing to use Oberdex after the effective date means you accept the new Terms.

15. General

These Terms and the Privacy Policy are the whole agreement between you and us about Oberdex. If a part is unenforceable the rest stays in effect. Our not enforcing something is not a waiver. You may not assign these Terms; we may assign them in a merger or sale.
